A friend sent me a link to this. (Thanks T) So looks like a liquor company is going to name an alcoholic beverage PORNSTAR. Interesting…

Wonder how that works if the word pornstar is trademarked, with sites like pornstar.com which in itself owns a trademark?
This is really lame.
Applying for a name for Alcoholic beverages EXCEPT beers; Distilled Spirits; Gin; Japanese white liquor (shochu); Liquor; Sake; Tequila; Vodka; Whiskey; Wines and sparkling wines.
Well, that covers just about everything alcoholic. So if it can’t be any of those things, WHAT IS IT???
Consumers would have to “guess”, I guess.
Anyway, the application has already been refused (although the refusal can be contested).
To answer Kelli’s question, a word/name/phrase can be trademarked or servicemarked more than once, providing the product or service is not the same or similar to one that is already trademarked. For example, “Pornstar” beer can be trademarked, because it is something entirely different than Pornstar.com (which is a website that primarily displays photos and videos). But for whatever reason, this application didn’t explain what their product really was other than some mystery alcoholic beverage that doesn’t contain any known or common types of alcohol.
