On a hot July morning in 1969, a pickup truck approaches the Spahn Ranch in the Chatsworth area of Los Angeles, home of the Manson family. Its passengers, Robert Kasabian and one of his friends tend to find out why Linda, Robert’s wife, fled home with their young daughter Tanya to join the Manson family. Furthermore, they’ve come to retrieve the cash that Linda stole from Robert’s friend’s trailer and gave to Charles Manson, the head of the Manson family. They’re being led to a room to meet Manson and resolve the issue. Robert snaps and start screaming at Manson and threatening him. Manson, while maintaining his eerie calm, pulls a knife out of his pocket and asks Robert to take it. Staring into Robert’s eyes, Manson whispers: ‘If you feel so strongly, then take this knife and bury it in my chest. Kill me, but understand that if I’m giving you the right to kill me, then I have the right to kill you, too. So kill me now or be killed or leave here and never return.’ Robert and his friend walk out of the room, get in the truck and drive away.
One month later on August 8, 1969, Manson sends Linda Kasabian along with Tex Watson, Leslie Van Houten, Patricia Krenwinkel and Susan Atkins to a house at 10050 Cielo Drive in Benedict Canyon, Los Angeles. He instructs them to ‘totally destroy everyone in the house, as gruesome as you can.’ Tex Watson and the girls follow the instructions carefully, and slaughter Wojciech Frykowski, Abigail Folger, Jay Sebring, Steven Parent and Sharon Tate, the eight and a half months pregnant wife of the Polish director Roman Polanski; first they put a rope around her nick and then stab her 16 times.
At the time of that horrible tragedy, Polanski was working on a project in Europe. Debra Tate, Sharon’s sister had to deliver the news to Polanski on the phone. Later in an interview she described Polanski’s reaction: ‘Roman is a tough man. He survived the World War II, he survived Poland’s communist dictatorship, and he survived many horrors. But when I told him what happened to Sharon, I could feel how he shattered on the other end of the line. It was so painful.’
Polanski’s life was never the same after that tragedy. It was as if the darkness embraced him and he embraced the darkness. In the years following Sharon Tate’s murder, he made some of the most bizarre, cynical and violent movies of his career: the Tragedy of Macbeth, Chinatown and the Tenant to name a few. He had lost his faith in humanity, and indeed who could blame him? He indulged himself in a life of debauchery and excess, and inevitably in 1977, the Samantha Gailey scandal happened, the 13 year old girl whom he had sex with. There are different stories suggesting different circumstances which led to that incident: Polanski says the whole thing was orchestrated by Gailey’s mother in order to blackmail him, Gailey’s mother insists her daughter was seduced, etc. Nevertheless, that incident was the birth of the modern day tabloid trash and America’s seemingly endless obsession with everything celebrities and scandals.
First, Polanski was charged with rape by use of drugs, perversion, sodomy, lewd and lascivious act upon a child under 14, and furnishing a controlled substance (methaqualone) to a minor. These charges were dismissed under the terms of his plea bargain, and he pleaded guilty to the lesser charge of engaging in unlawful sexual intercourse with a minor.
Under the terms of the plea agreement, the court ordered Polanski to report to a state prison for a 90-day psychiatric evaluation, but granted a stay of 90 days to allow him to complete his current project. Under the terms set by the court, he was permitted to travel abroad. Polanski returned to California and reported to Chino State Prison for the evaluation period, and was released after 42 days. All parties expected Polanski to get only probation at the subsequent sentencing hearing, but after an alleged conversation with LA Deputy District Attorney David Wells, judge Laurence J. Rittenband suggested to Polanski’s attorneys that he would send the director to prison and order him deported .As many journalists and historians suggest, this sudden, unexpected and unexplainable decision which was against all previous agreements, was judge Rittenband’s attempt to maintain his accidental celebrity status, extend his 15 minutes of fame and showcase his power over Hollywood celebrities. In response to the threat of imprisonment, Polanski fled the United States. Eventually he obtained French citizenship, married with French singer and actress Emmanuelle Seigner, rebuilt his life and made some of the best movies of the past 3 decades including Tess, Bitter Moon, Death and the Maiden, the Ninth Gate and the academy award winner the Pianist.
Roman Polanski’s recent arrest in Zürich, Swiss 3 decades after Samantha Gailey incident seems irrelevant. This incident could have been resolved back then if America’s tabloid trash culture and a judge’s desperate attempt at being an overnight celebrity wouldn’t have gotten in the way. In today’s crumbling America, where Jaycee Lee Dugard is being abducted and raped for 18 years by a registered sex offender on parole who gets caught only after he walks into the police office on his own will, I believe the law enforcement and the justice system of this country have more vital concerns and priorities other than arresting a 76 year old internationally acclaimed filmmaker over some tabloid controversy that occurred more than 30 years ago. The worst case scenario for Polanski would be that he’ll pay a fine, spend some months in prison and will be deported from the United States, the country that he abandoned it himself. But in reality, what does it say about us to the world? It says we’re a nation of overly confused, politically correct, tabloid trash obsessed morons with an inflated sense of righteousness that smacks us in the face time and again and yet we refuse to learn our lessons and determine our priorities, or in other words, put our shit together. Our heavy shades of grey won’t fade away easily.
What Roman did was wrong, he should come back and have his sentence abrogated. The prosecutor said he lied in that documentary, why would he say that, even if he did it throws doubt on the thousands of other cases he tried. The Judge is dead and thanks to the prosecutor it brings to whole proceeding to a strange place, fair trial my ass. Of course Charlie Manson started this whole weird road, and he’s still alive. Maybe Justice can be served in two ways, Roman can come back and do the rest of his time and he can do it with Manson. Except Roman can get a clean shot at Manson with a lead pipe, shank, brass knuckles, whatever it takes to rid this world of Charlie. Colonel, you’re right, we have far bigger fish to fry than Roman.
Roman Polanski is a child molester. The worst that the human race has to offer. With your logic, bankrobbers, terrorists, and anybody else just has to evade capture for 30 years and then it’s “all good”?
The judge does NOT have to accept any deal worked out between the prosecutors and defense. They only work out a SUGGESTED sentence. The judge has the right to say “fuck your suggestions” and prosecute a child molester to as long as he/she wants, under the law.
They didn’t send the National Guard to get him. They just got the Swiss to finally arrest his lecherous ass. You act like they sent the U.S. Army in with tanks and bombs and guns to get him. They picked him up, just like they’d pick up a bankrobber or murder or anybody else who’d evaded capture.

Well I could equally say it is because of incidents like the kidnapping of Jaycee Lee Dugard that ALL US jurisdictions need to establish and follow strict minimum sentencing statutes regarding the rape and exploitation of children. I agree that’s its a waste of manpower going after the old man now (especially since the victim is not interested in testifying or pursuing justice) but I agree with the sentiment that no one is above the law. There are people who did with Roman Polanski did and are now forced to camp out underneath a freeway while he’s winning Academy Awards (now, don’t get me wrong, he’s a great director).
I do not care about his right to a plea deal–he had none. Moreover, I cringe at the excuse that he has pushed to do what he did because of his wife’s murder for what he had done with Samantha Gailey, by his own account, was monstrous in its own right.

All the other window dressing elements in the op-ed are irrelevant, from the prosecutor (who was not trying the case) making statements to the documentary crew, to the judge legally ignoring the plea deal, to the murder by Manson’s crew. There is no doubt he did the crime and all the twisting & turning in the wind about misconduct means nothing considering he fled rather than appeal based on those factors.

Gailey herself has said she doesn’t beleive Polanski should go to jail for this and wants the matter finished. That’s the trump card for dropping the whole thing, whether you happen to like it or not. Why should anybody’s personal opinion matter more than the now adult victim decades later? You are not defending this particular victim if you disagree with her on her personal sexual violation. So then it becomes more about you. These cases should be judged independantly, yet thoroghly, and not with some broad brush and mandatory robot-like sentencing guidelines.

I hope you realize that I don’t tend to justify what Roman Polanski did. My main argument here is:
1. If the media wasn’t going to turn Samantha Gailey incident into a circus and if judge Rittenband was going to handle the case according to made agreements instead of seeking to extend his 15 minutes of fame, this case would have been dealth with and gotten over with in 1978. There was no need to drag it for more than 30 years.
2. In today’s America, there are far more serious issues to deal with instead of going after Roman Polanski. In a country where a registered on parole sex offender abducts an 11 year old girl, imprisons her in his backyard and rapes her for 18 years without even being noticed by the law enforcement, there are indeed much more serious priorities than bringing a 76 years old filmmaker to justice. Media rarely mentioned the story of Jaycee Lee Dugard because it was a complete, utter embarrassing failure of the law enforcement and justice system in this country; but when it comes to arresting an old man over a decades old incident which pales in coparison to Jaycee Lee Dugard tragedy, suddenly everybody goes ape shit and screams for justice. We must take a look at ourselves and see ourselves in a new and more realistic light, even though we might not like what we see.
3. Roman Polanski is one of the greatest filmmakers of his generation. Say what you want about his character and Samantha Gailey incident, but you should give credit where the credit is due. Nevertheless, his cinematic talents are undeniable and unsurpassed even though his character is flawed.
I don’t see the logic in Polanski going to prison. He can help many more important causes, by serving a community service and helping others. He’s already paid the victim a settlement, and from what I hear, she’d like to have him back for another romp…thats the way life goes. In the end, I doubt Mr. Polanski would willfully hurt anyone, and has no doubt paid his dues.
Child rapists should get what they deserve. Yes, Polanski is a great director but great directors can go to jail. I’ll admit I didn’t exactly know what Polanski did until recently. I thought he had screwed a 16 or 17 year old. However, when I found out he drugged, raped, and then ANALLY RAPED a THIRTEEN YEAR OLD GIRL then I just wish the worst for this piece of shit.

However, I noticed the word rape in capital letters over and over again. The only thing that I will tell you is that rape does not apply to this particular case. Argueably, Roman Polanski seduced the girl, and even though what he did was wrong, but still seduction is different from rape. So I suggest you do some through research and learn what the fuck you’re blabbering about before going small town house wife nuts and kicking yourself in the ass like a moron. There are more than enough resources to research about this case: articles, books, documentaries including first hand evidence and information such as interviews with the victim Samantha Gailey and LA Deputy District Attorney David Wells who was the case prosecutor at the time. It’s not in my job discription to educate house wives, so you have to do this one on your own.
Furthermore, right now a petition is being prepared by the movie industry to support Roman Polanski, and many legendary filmmakers including Martin Scorsese, David Lynch and Jack Nicholson have signed this petition so far; all of which are far more credible and informed than Kay Ryan.

Several thoughts on this appalling post:
1- Roman Polanski’s cinematic accomplishments are completely irrelevant to his crime of raping a 13 year old girl.
2- It was rape whether the mother lured him into it or not, or even if the 13 year old girl tried to seduce him. Polanski knew it was a 13 year old girl regardless of the circumstances.
3- Whether the now adult victim wants him punished or not is also irrelevant. Criminal prosecution and punishment is for the benefit of society at large. It isn’t an “eye for an eye” on behalf of the victim. It is done to protect other victims from this rapist and to try to deter other rapists.
4- Chances are high that, as with most child molesters, this wasn’t Polanski’s only victim. Just the only one he got caught for.
5- Ad hominem attacks on people who disagree do nothing to negate the points they made. Anyone who has read the original testimony in the case knows Polanski raped a child.
Today’s molesters like Colonel use more efficient drugs like roofies or GHB. I’m sure Polanski is wishing he had some of that so the girl couldn’t remember.

Likewise, former LA Deputy District Attorney David Wells recanted his statements made in the documentary about the Polanski case (HBO – Roman Polanski: Wanted and Desired).
In a nutshell, he lied about urging the judge in the case to throw the book at Polanski…as he thought 1) it would make for a better storyline in the documentary 2) he didn’t expect the documentary to be shown in America 3) see one and two.
Finally, when did the rape of a 13 year old girl (intoxicated from alcohol and Quaaludes) by a man over twice her age, somehow be equated to Tabloid Trash (which most would probably define as a celebrity tripping on the sidewalk accidently exposing themselves, and/or whomever they’re dating this week)?
Polanski’s art/fame/celebrity has nothing to do with his guilt — the time passed since the original charges, has nothing to do with his alleged ‘innocence’. If Polanski and his lawyers felt they were about to get a raw deal, then there were plenty of legitimate avenues to fight any perceived misdeeds by the prosecution. Yet they never had the chance to address any prosecutorial misconduct…because their client fled the country like the coward that he is, the child rapist he admitted as such to being when he entered a plea agreement of guilty to unlawful sexual activity with a minor.
It’s now time for Roman Polanski to finally face the music.
I think the most simple way of putting it is that if you agree with this post then you agree that there are circumstances in which rape is fine and deserves to go unpunished. Any rape deserves to be punished to the fullest extent of the law.

It is similar in that they were both loved personally and professionally and had public sympathies. O.J.s sympathies followed the beginning of the worst black/white race relations in the late 20th century, following the Rodney King beating, verdict and subsequent riot.
Sympathies for Polanski relate to his acclaim as a director and in particular lie with the trauma he lived with following pregnant Sharon Tate’s Manson cult murder.
Perhaps I’m missing something but does the girl who was the 13 or 14 year old victim want Polanski prosecuted and convicted? I think her feelings on the matter should be the crux of the issue at this point.

At the end of the day, Polanski will have received nothing close to what he’d gotten within the US Legal System if he was a regular defendant up on the same exact charges (having committing the same act of fleeing the country).

Polanski has already been prosecuted….He plead guilty and was going to be sentenced but fled the country. There will not be another trial.
