“As a global HIV and STD medical provider operating treatment clinics and prevention facilities here in California, we see it as our duty to pursue action on the issue of safety in the workplace—in these instances, unprotected sex acts taking place in albeit non-traditional workplaces—porn sets located throughout the San Fernando Valley that are churning out billions of dollars of adult fare every day,” said Michael Weinstein, President of AIDS Healthcare Foundation. “This is why we are filing workplace health and safety complaints with Cal/OSHA today: to press for the enforcement of state and local workplace regulatory guidelines which would require the use of condoms in all adult films produced in California.”

“I was a porn star living the glamorous life. Drug overdoses, herpes, suicide attempts and abuse at the hands of the porn industry,” said Shelley Lubben, former porn actress and founder of the Pink Cross Foundation, an IRS approved 501(c)(3) public charity dedicated to offering adult industry workers emotional, financial and transitional support for those who want out of the adult industry. “In my time in the industry, I did some very hardcore movies, and only drugs and alcohol could get me through them. I played a crazy game of Russian roulette with my life. The industry did not and still does NOT enforce condom usage, so STDs and HIV were and still are a high risk among porn actors and actresses. While my own life has taken an entirely new and profoundly fulfilling direction and I now work to help performers leave the industry altogether, I wholeheartedly support AIDS Healthcare Foundation’s call to require condom use in the ongoing production of adult films in California.”

“It breaks my heart to acknowledge that during my time as a porn star, I’ve done a scene with 25 men and even though I was assured that all of the STD testing had been taken care of by the producers, in my heart I realize now that this was probably a lie because I never saw the tests for myself,” said Jan (Meza) Merritt, former porn actress and member of the Pink Cross Foundation. “There are thousands of porn stars actively working in the adult industry. Can AIM say in all honesty that they are able to accurately test and regulate all of these performers’ health? I think not. How is AIM certain that their tests are foolproof when nothing in this life is guaranteed, not even the use of condoms, contraceptives and other prophylactics? And how much higher is the risk of getting HIV and other STDs in an industry where you have not only one sexual partner per day, but several or more and condoms are looked at as an unnecessary, negative component of this industry? Enough is enough! How many more HIV incidents will occur in the adult industry before changes are made once and for all? 22 reported cases of HIV. How can anyone say that’s a small number? We are talking about human lives! How can you put a price on life?"

“While working in the industry, I performed in over one-hundred triple-X hardcore movies. Some of my experiences on the porn set include me being totally wasted and porn producers allowing me to be—and even providing—alcohol and drugs for me. I experienced rough sex scenes and have been hit by male talent and told them to stop, but they wouldn’t stop until I started to cry and ruined the scene,” said Michelle Avanti, a former adult entertainment actress and member of the Pink Cross Foundation in a statement. “As I continued to do hardcore porn, I started catching STDs all the time. My lower body hurt so badly and at times my private area felt like it was a blazing fire. I could no longer work because I caught so many STDs and infections. I believe that if condoms had been allowed to be used in my own films, I would not have suffered so many physical ailments and infections. I am pleased today to lend my support to AHF’s call to require condom use in adult films produced in California.”

At the conclusion of the press conference AHF officials (together with the actresses?) will depart in a caravan from the hotel to deliver the complaints and the supporting DVDs to the body informally known as Cal/OSHA

In support of its complaint to Cal/OSHA asserting that film sets where condoms are not used provide unsafe California work environments, AIDS Healthcare Foundation officials undertook a review and analysis of nearly 60 adult films produced and/or distributed by the industry. AHF will submit the DVDs to Cal/OSHA in support of its workplace safety complaint regarding these California film sets. Among AHF’s findings:

• 58 adult entertainment (porn) DVDs purchased;
• 16 production and/or distribution companies represented;
• 15 DVDs depict double penetration (two penises) WITHOUT a condom; one portrays unprotected double penetration in one orifice (anal, a particularly high risk behavior for possible tearing of the membrane and lining of the anus);
• 7 DVDs featuring Spanish language and Latino/Latina performers; in one of these DVDs, CONDOMS ARE USED
• 5 DVDs (primarily) featuring African Americans; in one of these DVDs, CONDOMS ARE USED
• 2 DVDs featuring Asian women
• 3 gay and/or bisexual BAREBACK (no condom) DVDs

AHF filed the lawsuit after exhausting all other methods to compel the County to fulfill its obligation to protect the public’s health in the wake of the revelation in mid-June that an actress working in the adult film business had tested positive for HIV. At that time, AHF had urged the County to better monitor HIV and STD prevention in the region’s adult film industry—and require condom use—or to shut down porn sets.

“By recommending—but not requiring—condom use on porn film sets, Los Angeles County has basically abdicated its responsibility to perform its main function—which is to protect the public health,” said Whitney Engeran-Cordova, Director of AIDS Healthcare Foundation’s Public Health Division. “The County’s laze faire attitude on this issue prompted us to prepare a ‘Notice of Safety or Health Hazards’ complaint for Cal/OSHA. We hope that Cal/OSHA investigators see this as the straightforward workplace safety issue we believe it to be, with the knowledge that thousands of STDs could be prevented in Los Angeles County with the mandated use of condoms on porn sets.”

AHF, the US’ largest non-profit HIV/AIDS healthcare provider, which operates the largest community-based alternative HIV testing program in California conducting more than 14,000 free HIV tests annually, has also been trying to sponsor legislation in Sacramento that would mandate the use condoms by actors performing in films produced by the California industry. AHF believes a so-called ‘condoms in porn’ bill should be drafted as a worker safety provision of California’s Labor Code akin to how the Labor Code currently requires the use of hard hats and other garments and barriers as safely precautions on certain California work sites and locations. To date, the legislators approached have been unwilling or unable to author such prudent public health legislation

Los Angeles County’s Department of Public Health is aware of an ongoing and pervasive sexually transmitted disease crisis in LA’s pornography industry, a fact that is well documented. DPH has cited numerous figures confirming an STD epidemic among performers in adult films, including the fact that performers in hardcore pornography are ten times more likely to be infected with a sexually transmitted disease than members of the population at large.

“This is not just about one industry, but about our entire community, as the spread of disease among adult film performers endangers themselves as well as their sexual partners in and outside the industry,” added AHF’s Weinstein. “Los Angeles County Public Health officials cannot keep passing the buck on this by playing ping pong on this with the state and the industry itself. That is why we are filing these complaints with Cal/OSHA today.”

    Why doesn’t some individual or company from the Porn Biz sue Shelly Lubben for mis-representation and potential slander?

    It seems to me that 1) anyone entering porn knows the risk due to the simple fact, they’re a human being who has sex 2) there’s no government regulations specifying men HAVE to use a condom whenever they have sex with a random person in either a professional setting (ie their workplace) or in public (ie a pick up at a bar/restaurant/beach et cetera and 3) see one and two.

    Lubben’s case on its merits alone should be throw out by any judge with half a brain, as one would have to ask why doesn’t she name EVERY SINGLE company in the Pornographic Business in her suit. Any good lawyer could argue that she’s playing favorites by not mentioning every last company producing pornography in the world who do not make condom usage mandatory.

    Besides, it’s not as if the state of California needs any more regulation that either strangles commerce, or adds more non-necessary workers to the government payrolls. Schools are being shut down, parks are being closed, and free clinics are being shuttered…yet the state’s OSHA department is supposed to add MORE staffers to go out and police porn sets and/or watch random movies in order to then cite companies that are not complying with the law?

    Can’t she just go and interrupt congressional town hall meetings with moronic rants against the progress of society like the rest of the nation’s nutcakes?

    Great post, Sammy. You brought up many good and valid points and as you mentioned, this charade is the last burden that bankrupt state of California needs on it’s fragile shoulders. So in all likelihood, Shelly Lubben’s fat ass along with this redundant case will be thrown to the street.

    But let me emphasize on one thing and provide an example of how blind, clueless and misinformed Shelly Lunnen truely is in her pathetic little crusade:

    Several of the companies listed by her including Anarchy Films, Heatwave Entertainment and Immoral Productions are companies that have technically gone broke a long time ago. They’ve became what the industry people call recycled content scavengers. They hardly produce any new material. Instead, they buy cheap, old, recycled content. Small time companies, obscure web sites and freelance producers who have shot scenes several years ago sell those scenes for as cheap as $500 each to these companies, then they put together 4 or 5 of them and make it into a DVD release. So basically stupid Shelly Lubben is going after companies who barely shoot new scenes and are not the original producers of the scenes they release on their DVDs. Shelly Lubben is and always will be a fart joke.

If you don’t want STD’s while making porn “DON’T MAKE PORN!” And as for HIV let’s be real, a lot of the people who tested positive where already having unprotected sex outside of the industry, inbetween test dates, best bet test every two weeks and take care of your self, if you feel the itching and burning get checked out, don’t wait… No one ever mentions staff and strep infections which can kill you if not treated.

With the TTBOY precenedt already upheld on appeal, what makes everybody here think that these cases are going to be decided any differenty?     And regarding the picking and choosing…On GFY the guy from IMMORAL PRoductions(I think that is porno dan, not sure) asked the question, why doesnt she go after everybody instead of picking and choosing. The simple answer is…she doesnt have too.

    I wouldnt be surprised if Shelley went out this weekend to an adutl bookstore, purchased a few more IMoral Production dvd’s and filed a few more complaints against this company. Each individual coplaint, under the sections they are alleging, caries fines well into the 30 to 60 to 160000 dollar range PER OFFENSE.
    Or better yet, she shoudl go some Zero tolerance, Red light, anabolic, etc etc. and fill out a few more OSHA complaint forms with the same violations listed. Its a one page form that takes about 45 seconds to fill out and another 45 seconds fo fax to OSHA. Its free, and anybody can do it.

    And if you are a producer, and you hire people to do a job from which you will make a profit, then you are responsible for the health and safety of those you employ to do that job. You, the producer,(the employer) are also responsible, as are YOUR employees, to follow all the laws of the State in which you have a business license. If YOUR employees violate the law, and you are aware of it, and do nothing about it, you are responsible. If you are an employer, and you hire somone to do a job with forseeable risks it is your responsibiley to minimize those risks.
    If you choose to be a producer, and hire poeple to take risks without offering any protection against those risks, then yes, YOU ARE RESPOSNIBLE FOR YOUR ACTIONS.

    Remember, according to the laws that make porn legal, this is just a performance in front of a camera for the purpose of making a profit from selling visual depitctions of the performance, it is not sex for the sake of the gratification on either participant. The act of sex is for the financial benefit of the producer and empoyees, and the employer is responsible for what happnes in the workplace.

    Responsibility sure is a bitch aint it Rockpete. In the workplace, the buck stops with the boss, not the employees who are doing exactly what the boss has hired them for.

It seem AIMs monthly testing for them are virtually worthless as it takes mere days to develop symptoms and days or weeks to treat and be rid of it.     Regarding HPV the virus is believed to affect an estimated 80% of the general population. Surely it must be higher in the porn industry, but the molecular composition is the same as chicken pox, which kids get and then build an immunity to. The reason we get inoculations is based on the theory of using our own natural immune system to fight and overcome germs, bacteria, etc.

    Most HPV infections in young females are temporary and have little long-term significance. 70% of infections are gone in 1 year and 90% in 2 years.
    That’s the immune system at work. Of course if one is doing lots of drugs, then their immune system is greatly weakened and this allows opportunistic infections to wreak havoc when normally they would be neutralized by the body’s own natural defenses.

    Surely women in particular should get checked regularly as HPV can at worst if untreated lead to cervical cancer. Women should use the extra money they make compared to guys to make sure they are feeding themselves well, not taking too many drugs, and not spend all their money at malls and they should be o.k.

    Are you seriously that ignorant of whats going on here? This is not a court case and there is no court or judge involved. These are OSHA complaints, and OSHA officials will determine the validity of the case, and based on the TTBOY precedent, and the fact that these cases involve the exact same regulations one can pretty much predict what their decision will be.

    I haven’t seen So I Married an Axe Murderer, but I guess it should be one of Mike Myers’ better movies. He hasn’t been interesting in recent years, though his Austin Powers movies had some funny moments.

    My favorite scene from Austin Powers: International Man of Mystery is when Dr. Evil who is brought out of a 30 year period cryofreeze, contacts the United Nations and demands a 1 million dollar ransom, because he still thinks one million dollar is a lot of money and everybody laughs at him.
