Dear Sir:

This office has been retained to protect the intellectual property rights and otherwise represent the interests of Anutza Herling, dba Shyla Foxxxx.(R) Ms. Herling owns all rights, including a Federally Registered Trademark to the name "Shyla Foxxxx.(R)"

A periodic internet search by my client has uncovered your l-keford.com webcite. Further investigation shows that your site is a commercial venture, as it includes commercial advertisement links and is obviously an attempt to acquire a publisher for your "on-line book."

It is my client's position that you are infringing upon the Shyla Foxxxx(R) Trademark (See section 32(a) of the Lanham Trademark Act of 1946) and further, that you are in violation of various State and Federal unfair competition statutes. Clearly, the inclusion of Shyla Foxxxx(R) is calculated to increase interest in your cite, and any possible future book, and might be construed by your customers to be licensed, supported and/or approved by Ms. Herling, which it is not. Further, it is obvious that inclusion of Shyla Foxxxx(R) is calculated to allow your company to financially benefit from the unauthorized and surreptitious exploitation of my client's registered Tradename.

Demand is hereby made that you immediately cease and desist from any further infringement.

Additionally, demand is hereby made that you immediately cease and desist making any use, whatsoever, of Shyla Foxxxx(R), or any other mark which is deceptively similar to Shyla Foxxxx(R), in connection with any commercial or other delivery, in any medium, of any goods and/or services.

Please be advised that 15 U.S.C.A S 1117(a) allows my client to recover from you any and all profits derived from infringing said Trademark. Accordingly, should you not adequately respond to this demand in a timely manner, suit will be filed in Federal Court, pursuant to 15 U.S.C.A S 1121(a), demanding an immediate accounting of all sales and/or profits generated by you since you first included Shyla Foxxxx(R) in your webcite.

Additional remedies available to my client under 15 U.S.C.A S 1117 et seq include, but are not limited to; temporary and permanent injunctive relief (See 15 U.S.C.A 1116(a)), the impounding and subsequent destruction of all materials enabling your continued infringement (See 15 U.S.C.A. 1118), and recovery of three times my client's actual damages in addition to any and all profits derived by you resulting from infringing on my client's Trademark.

Further, my client may recover from you any and all costs incurred in the enforcement of his trademark, including but not limited to court costs and attorney's fees. (See 15 U.S.C.A. 1117(a))

Be advised that 18 U.S.C.A. S 2320 provides that any knowing use of a spurious mark in the transfer of goods or services may subject you to a fine up to one million dollars ($1,000,000.00) and/or imprisonment up to five (5) years.

I have advised my client that she should afford you a reasonable opportunity to contact this office in an effort to settle this matter, before she initiates litigation. She has tentatively agreed. However, she will pursue all available legal and equitable remedies, to the full extent the law allows, should you fail to immediately comply with these demands.

Any communications pertaining to this matter should be forwarded to this office at the address and telephone numbers listed on my letterhead. If you are represented by counsel, your attorney should contact me directly.

This is the only opportunity my client will grant you to avoid the filing of a federal trademark infringement action. Should you fail to respond, any further communications from my client will be in the form of service of process informing you that litigation has commenced.

I don't know much about intellectual property law, but I would agree with you that there isn't any prohibition on writing about a trademark. I appreciate the fact that you don't sugar coat things in the world of porn. It seems like the people who finance the porn world and the directors don't want us to see the manipulation of women that goes on because it's their cash cow and the women don't want to admit that they are stuck in a bad situation most likely due to drugs. I was reading some stuff about Shyla Foxxx who is long retired but was one of my favourite stars at one point. It appears that she is suffering from hep c ... very unfortunate. I look at some of her pictures on the net and she looks like she is high in all of them, one set was particularly bad where she had bags under her eyes and they were bloodshot. What did you here about Shyla and her use of drugs ? ... that's one thing I like about Tom Byron .. at least he admits to being high most of the time and doesn't try and make the porn world out to be a great breeding ground for University graduates and leaders of tomorrow like the stars try and tell us .. I swear every one of them is planning on being an astronaut.

I'm just curious because it really seemed like Shyla was strung out in the photos and to do the scenes she did for John T Bone you'd have to be flying.
