Attorney General Gonzales Signs Order Adopting Revised
Regulations Implementing Section 2257

The United States Justice Department announced Tuesday that Attorney
General Alberto Gonzales has signed a final rule containing changes
to the Justice Department regulations implementing 18 USC Section 2257
. These changes will become effective thirty days after their publication
in the Federal Register unless their enforcement is enjoined by a federal
court. Until they are published, we cannot know how closely they resemble
the changes proposed last June by the Justice Department. A table comparing
the existing regulations with the June 2004 proposal is found here.

Contrary to at least one GFY-posted account, the sky may not actually
be falling. The promulgation points however to a present intention on
the part of DOJ to actually enforce Section 2257 for the first time.
Indeed, there may be something falling on the heads of those who have
not taken the law seriously, but it will not be the sky.
The press release does put quotation marks around the term "pornography
producers", a term that does not exist in the present statute or regulations
or the proposed regulation, and hints that the final version has been
modified, probably in the direction of the so-called "secondary producer"
requirements; Though at least one US Court of Appeals has found the
provisions to work beyond the authority of the Justice Department, the
existing regulations have always required web publishers who buy content
made by others to obtain and retain and make available for inspection
the original documents and alias information obtained by the original
content producers.
Substantial parts of the proposal made last Summer were unconstitutional
on their face - notably the inspection requirement that mandated availability
for inspection of the records from 8am to 6pm. The burden this onerous
requirement would place on part-time webmasters would eliminate substantial
constitutionally protected expression. The proposal also required the
long-term archiving of terabyte upon terabyte of live, streaming content
for many years - and the expensive segregation of this data from the
working servers of sites.
All of this was related to Justice by this firm during the comment
period, and we will shortly know whether any of the hardship was taken
into account in the final rule. To the extent that the regulations unreasonably
burden Free Expression, they are unconstitutional and void. We believe
that they are subject to the demanding constitutional test of "strict
scrutiny" though one prior Court of Appeals decision applied the less
demanding, but still vigorous "intermediate scrutiny". The Free Speech
Coalition can be expected to take point at the forward edge of this
battle by initiating litigation. This would be a really, really good
time to join.
FSC is not only advancing the interests of the Webmasters (the most
numerous class of "secondary producers", but it has made significant
outreach to the web community by its recent hiring of Tom Hymes, formerly
with AVN Online, as its communications director. It is my best hunch
that Justice would not be promulgating the changes without plans to
enforce in the immediate future.

products, but I don't really think they read the reviews either. Likewise
with packaging. Everybody, consumers and retailers alike, has been burned
on crap-in-a-fancy-box so many times, I don't think that scam works

why companies like EA do so well. No retailer need worry that an EA
title is going to sit on the shelf for long. The consumers have voted
for EA products so often, the retailer has virtually zero risk from
stocking practically any EA title. I discovered this myself in a bookstore
in Denver where I saw a huge EA display in the front of the shop and
suggested to the manager that those titles must sell pretty well. His
reply: They're the only ones that do.
In other words, proven sales performance has more impact on wholesale
than reviews or company promotion. Companies, directors and performers
with established demand will always do better out the door, regardless
of all other factors.
Therefore, in the end, consumers are the most important factor. If
they buy products from a certain source, that source will sell more
products. If not, not. It may take some time for consumers to catch
on to hot, new stuff, but word does get around and I do believe that
most top-notch porn will find a market. Junk that's shoved down the
buyer's throat will get spit up in a hurry, as has been demonstrated
by some heavily promoted lines that got fawning reviews because the
producers were big advertisers and did nothing on the bottom line. I
could name a few examples here, but I have enough enemies already.
For what it's worth, I think the porn consumer of today has it better
than at any time in the history of the industry. There's more good product
out there, and more variety, than ever before. And the ability to communicate
with other consumers via the Internet has given an advantage to the
customers they never had previously. At the same time, the influence
of reviewing publications has declined in proportion, which is not a
bad thing to my way of thinking.

I wouldn't have any problem with this type of material if both the
actress and Director were "in on it" and by that I mean both are simply
playing roles to fulfill the desires of a certain segment of the viewing
audience. Unfortunately, it is my sincere belief that at least some
of the people churning this stuff out truly hate women. There is no
role playing going on here. What you then end up with is a director
who is getting off on distilling his personal issues through the humiliation
and abuse of a girl in front of his video camera and a girl waiting
for it to end so she can get paid and go home. For me, that takes it
out of the realm of fantasy altogether. Certainly it shouldn't be banned
or censored but it should at least be acknowledged that there are some
truly evil motherf---ers in this business.

The documentary you're vaguely refer to, was done by a freelance outfit
out of the UK, who then sold it to Channel 4. The piece was a complete
'hatchet job,' a total set-up, and those boys did a real fine job at
making porn look bad. But the reality of the situation is much less
shocking.
The girl in question, Felicity, was brought in by their crew, and was
a 'ringer' in their effort to make hardcore porn look bad. That's what
sells! They used this chick in ways I would never imagine doing, basically
ruining her life at home in England. Felicity came packing some pretty
heavy emotional baggage, which I didn't know about before hand, but
when she snapped on the set only a few minutes into the scene, I knew
that she wasn't mentally fit for this business. I talked to her after
she walked off the set without explanation, and had a calm chat with
her up in the dressing room. At NO TIME did I yell at, or berate her.
But I could see that there was no way we were going to finish the scene.
I simply said okay, and that's that.
The documentary crew scrambled up the timeline to make it look as bad
as possible for me. But I don't really care except that they keep reserecting
the damn report, then I have to explain it all over again. I'll leave
you with this: There's no way anyone can speak with authority on what's
really happening on a set, or how a girl feels, unless they are there
the whole time. As has been pointed out numerous times in this thread,
some girls like it rough, and have no problems on the set. Other girls
aren't so comfortable with it, and that's why I go out of my way to
explain things to them before hand, using video, pictures, and exit
interviews with girls who've previously worked for me.
If they're not down with the program, they're free to leave anytime,
and I tell them that before we roll a single frame.

After a week and a royal screwup by Time Warner on my internet - I
am finally back on line.
I appreciate that you came to me with these questions. To answer them
quickly, no we did not require anybody to pay to speak on any panel,
and yes, Eric Bernstein is a corporate sponsor [of the legal panel],
so of course he's getting a lot of exposure at the show. We always try
to take care of show sponsors since they contribute and make Cybernet
Expo possible. None of the speakers on our panel discussions have ever
paid to be on the panel.. I have had many legal panels, consisting of
a dozen attornies. We do give our Sponsors and Exhibitors the first
crack at spots. This IS a business, and they expect marketing opportunities.
But, take a look at our seminars again...... there are many on them
who are NOT sponsors.
I am not sure who the FALA [First Amendment Lawyers Association] attorneys
are? But, no one was asked to pay to be on a panel. We have NO openings
on any of the panels & have not had any for some time. Those who were
interested in being on a panel had since last January to contact Jay.
We have had to turn down several people in the last 10 days - they just
waited too long. There is no story here.....This is Cybernet's 8th year
& people who have been around, know that I never cave in to political
pressures.
I find it hard to believe that any prominent businessman in the industry,
including Fay, has never caved in to political pressures. I remember when
the Cybernet Expo used to have an awards show, but this was cancelled
after the Montreal show in May 1999 because Ron Levi and other prominent
business leaders denounced it.

People's Choice awards were fun for everyone, even those who did not win!
The second year was hell, because to some in the business, it became an
ego problem. Because it was way too much work, to have to deal with threats

rooms & the 'nuts & bolts things. I work pretty much in the background.
I hate politics, so this suits me just fine. I was in the process of
moving when you wrote, and without internet. Jay called me about any
emails that I needed to take care of. What couldn't wait I called &
he replied to the others for me.
When I announced my retirement 2 years ago, I was contacted by several
who had offers or plans. Most not in the best interests of the show
as a whole. I met with Bob and Jay [at YNOT] and found that we could
have a good working relationship. It worked well last year, and yes,
Jay is a godsend!

Thursday night. It's hard to find parking on Cahuenga Blvd. I end up
near Santa Monica Blvd, and my car is still a few feet into the red.
I arrive at the club
Tokio (1640 N. Cahuenga Blvd, near Hollywood Blvd) at 10:15. The first
porn person I see is Ryan Knox. I ask him about Porn Star Karaoke Tuesday
night. There was a good turnout for Keiko's birthday -- her husband Rob
Longshot, Pamela Peaks, Kris Slater, Coffee Ron (director), an intoxicated
Jim South Jr. with his girlfriend Holly Wellin, Roy Karch, Rusty Nails,
Don Hollywood and his wife Brooke Hunter. James Dean had to stay outside
because he's only 19.
In his six months in the biz, Ryan, 25, has done 33-scenes.

Duke: "When did you get your first tattoo?"
Bella: "When I was 18. Two years later, I covered it (butterfly)
up with three-feet wings on my back."
Bella says she has three names tattooed on her body, three ex-fiances
(she broke up with all of them). She claims she regrets none of these
tattoos (nor the relationships). "It's like a diary that I write
on myself. They're all experiences."
Duke: "Why didn't you get married?"
Bella: "It's too scary. I'm too young. I'm 23 and I don't plan to
get married any time soon. They weren't the right people. I'm a heartbreaker,
I guess."
Duke: "What do you do 9-5?"
Bella: "I'm an alternative model. I'm shooting with MTV's Jackass
Saturday. I've done Nordstroms, Gucci, big names. They're into tattoos
now.
"Before I got tattooed, I only got one out of ten jobs [she auditioned
for]. Now I get eight out of ten. It's having that shtick, that interesting
thing that people can look at. Anybody can be a pretty face. You have
to be different."
Bella has four piercings, none I can see. One on each of her nipples,
and her belly button and down below.
Duke: "What was it like the first time you posed naked?"
Bella: "It was uncomfortable but Misty (owner of Suicidegirls.com)
is an incredible woman. She made me comfortable. You can be yourself and
be interesting and be beautiful and not feel uncomfortable because it
is not a male photographer."
Duke: "When you were a kid, what did you want to be when you grew
up?"
Bella: "A ballerina. I was a cheerleader in highschool. I've done
everything. Three years ago, I bought a tattoo shop in Seattle [where
she's from]. I have the whole alternative vibe going."
Bella has lived in Los Angeles for over two years. One of her ex-fiances
runs her tattoo shop -- Easy Choppers and Tattoos in Bellevue, Washington.
Duke: "Did you notice any difference in the way people you treat
you when you got tattoos?"
Bella: "Absolutely. People treat you like you're a criminal or a
drug addict. I've had problems in the past but not since I got tattoos.
Tattoos are a rush. They supplement for drugs and stuff like that. I get
an endorphin rush that you wouldn't get from anything else. Whenever I
feel the need to drink heavily or do drugs, I just go get a tattoo.
"They say tattooing is addictive. I completely agree with that."
Duke: "Is there a part of yourself that wants to hurt yourself that
is satisfied by getting a tattoo?"
Bella: "No. It's more the art aspect. People can paint or create
a sculpture. I get tattooed. That's my form of art."
Duke: "How have tattoos affected the way you carry yourself in the
world?"
Bella: "It's definitely affected how I deal with people on a daily
basis. Sometimes you don't get the best reactions."
Duke: "So you've built up a thicker skin?"
Bella: "Exactly. I've built up a tolerance to people. I get a lot
of men who walk up to me and say, 'You'd be beautiful if you weren't tattooed.'
I'm like, why be beautiful? You're so ugly.
"I love who I am as a person. I know I'm a good person. I've got
good karma."
Duke: "Has it affected the crowd you hang out with?"
Bella: "No. The men that I date generally don't have tattoos. I
look at tattoos every day in the mirror. It's like a t-shirt that you
can't take off. It's hard for me to date a guy who has piercings or tattoos.
"Jealousy is hard for me to handle [in a guy]. I'm obviously a nude
model. I promote clubs every night. If somebody is jealous, I can not
handle that. That's my job. That's why I've been single for two years
now."
Duke: "How do you deal with monogamy?"
Bella: "I'm a very monogamous person. People assume that just because
I'm tattooed, I'm promiscuous."
She says she's slept with fewer than ten men in her life.
Duke: "How did your parents react to your tattoos?"
Bella: "My mom said, 'You're ruining the skin that I gave you. I
still love you.' I said, there's no still love you. There's love you,
period. No, I'm going to love you. You either love someone or you don't.
There's no in-between."
Duke: "What do you love and hate about your life now?"
Bella: "I love my friends who are there for me through thick and
thin, through addictions, through going out every night. I hate the people
that weren't there. The people who bailed because it was easier to do
that."
Duke: "What do you love and hate about LA?"
Bella: "I love the weather. I hate that it is so superficial. I'm
just starting to see now billboards with tattoos and flyers and advertisements...
But on the other hand, you can't promote Sky Vodka unless you're Heather
Graham."
Bella introduces me to three Suicide girls - Erika, Stacey and Desiree.
I should interview them but I'm too chicken. Erika is a stunning singer
and a Penelope Cruz-lookalike.
I don't see any tattoos or piercings on them. I guess they're hidden.
I'm in a room full of beautiful young women yet I can't muster the least

This last Thursday, I had decided to sever my ties with Suicidegirls.com.
The reason? I was zotted over something that I did not do. Sean, the
Fuehrer of SG, claimed I was soliciting the SG models. That is total
bulls---! Never did such a thing take place! I sent three emails to
Sean defending myself and this allegation and I also demanded proof
that I did. I never got any response from him. The problems though go
even further than what happened. A couple of months ago, I was a member
of SG's Seattle group until the recent group manager booted me out.
She claimed I was not attending that many events plus I made some of
the members feel "uncomfortable". This was a double dose of bulls---!
It seems pretty rich from the group manager to ban me because I wasn't
attending enough events. She wasn't attending many of the events either!
As for making people feel "uncomfortable", I never did or said anything
to hurt or offend anybody!Before she became the group leader, there
were no problems. The previous group leader was cool and had no problems
with me whatsoever! I think what is happening is that SG Seattle has
basically become a stupid, childish elitist social clique. If you ain't
their defenition of "cool", then you ain't getting in!
Don't get me wrong. I don't hate a lot of the people on SG. Many of
them are cool people and I have made some good friends. I even visited
Portland, Oregon a few weeks ago. I was still a member of Portland SG,
Portland SG, a far better group than SG Seattle and a better group leader
(Ryan, an SG girl and one cool person!) and I thought I would hang out
with some of them. Had a really cool time! This was one of the reasons
I would have stayed on at SG. At least there were some people I liked
and had no problems with them and they had no problem with me! I was
hoping to stay on but I guess Sean SG had some other ideas.
To sum up all that has happened, I have come to the conclusion that
the people that are running SG have had their heads have become swelled
and have let their success get the best of them. Also, certain elitist,
"more punk rock/goth/indy than thou" people have ruined what was a perfectly

XBIZ is owned by a webmaster [Alec Helmy] who is known for his scruples
in this industry- it also so happens he has run a very successful affiliate
program for a very long time GIGACASH. I think if you read their magazine
more closely you'll see what the webmasters really and truly want- REAL
ARTICLES from REAL WEB OWNERS and PEOPLE IN THE KNOW and not just GREEDY
ads- If you told me that Grim SHawn was writing for you next month with
Porn Daddy - It wouldn't surprise me in th eleast.... You are forgetting
my sister in law was responsible for selling all the ads over there-
and I yelled and screamed at her that AVN sucked the entire time she
worked there as well. Don't believe me? ask her. Of course there aren't
as many ads these days...

Access shows, and the Cybernet Expo- Sure Internext is a great time
and an excuse to come see many webmasters- but I see enough of them
at the Players Ball- which by the way will always be at the same time

F). I am always being measured up to my brother in this business who
has absolutely nothing to do with my business- he did get me into it
and we do promote the Players Ball together, but other than that we

G). I am sick and tired of watching people who have serious drug problems
and make $20,000 a yr come to shows and to boards with an attitude like

H) I am tired of making others look good- and making millions of dollars
for people who tell me i'LL BE REWARDED HANDSOMELY and then disappear.

* Advertiser phone number does not work
* Advertiser does not respond to phone calls Advertiser deposit IP
does not match contact info.
* Advertiser deposit IP comes from High Fraud area (Eastern Europe)
* Advertiser has not been active for 30 days (full c-card billing cycle)
* Advertiser uses multiple credit cards Very quick ramp up in advertising
(big spends without testing the system for positive ROI first)
* Advertiser does not own his own websites (he is an affiliate)
* Tries to bid on large list of generic keywords
* Makes multiple deposits in the same day

I love animals, and I think it has a lot to do with the maternal instinct
that most women have. Biology has made women into mothers automatically.

valley.
If half of the people in porn cared about humans half as much as they
cared about these animals then maybe their critisism of this company
would have some credibility. But standing up for animal rights while
remaining completely silent about the rights of human beings is the
epitomy of hypocrisy.
How much money have porn people donated to these causes? How much money
have any of these people put up for those infected whit hiv in your
industry? The answer to the second question is very close to absolutely
nothing.
Now if you will excuse me i'm going fishing. And yes, I am going to
kill those fish,and barbque them in a light lemon sauce with a hint
of garlic. Maybe I'll even videotape the cleaning of the fish.
For the record, I too find this type of entertainment disgusting and
worthy of all of the critisism that is being thrown at them. But lets
