I've heard from several sources that AVN reporter Mark Kernes has obtained a couple of faked HIV tests of HIV positive ex-performer Marc Wallice. Kernes had no comment Friday afternoon. He reportedly fears physical retaliation from Wallice for his investigative efforts. Marc's high viral count on his late April 1998 DNA PCR test which first proved him HIV positive makes it likely that Marc had had the HIV virus for at least six months.

"Any doctor would tell you that his March 30th [1998] ELISA had to have been forged," says a leading porner.

Pat Riley rejoins: "Another wild statement from the usual low-brain-power porn industry. ELISA tests for antibodies, not directly for HIV itself and depending on the individual the body may not produce sufficient antibodies to register a positive result for up to six months. In fact, there's one case (Texas, I believe) where the guy progressed right through to full-blown AIDS without ever registering positive on
ELISA. He did however show HIV+ on DNA testing and Western Blot. (Medline not Springer). So no doctor worth his salt would make such a wild sweeping statement. OTOH he's probably right that the test was forged given the sleazy nature of Wallice and others involved.

"The viral load is neither indicative of whether the ELISA test will show positive nor of the length of time a person has had the virus according to the written statement of Dr Robert Holtzman, a professor of infectious diseases at NYU, that I posted when this story originally broke. While to the layman, myself included, it would seem
logical that the virus gets into your body and then multiplies giving rise to the idea that the level of virus is related to how much multiplication has gone on and hence the time since infection, that's only part of the story. The antibodies do work as do the killer T cells causing a see saw effect and at some later stages of infection
the tested viral load will actually drop to insignificant levels (the virus is lurking in the lymph cells and elsewhere). A high viral load is an indication to pile on the medication--the protease inhibitors prevent the free-floating virus from hooking onto the cells. Neither the PCR test nor the Western Blot can prove that a previous ELISA test was faked.

"While I'm all in favor of hanging any venereally-diseased person who has sex with others from the nearest lamp post, the problem is with the word "knowingly"--actually "intentionally". Prove animus! Very tough because he can probably honestly say that he didn't intend to infect anyone.

"What is needed is a law that says "If you know or should know you're HIV+ and you have sex with anyone, you're automatically presumed to have intent." but each time such a law is proposed it gets beaten back by the gay lobby. Don't forget that lots of the leaders of that group are HIV+ and such a law would effectively stop them having sex."

RAME's Brad Williams: "I completely agree with Patrick. The "leading porner" is clueless about HIV and Marc Wallice, and it shows with the idea that he perhaps infected Barbara Doll over 3 years before "all the rest."

"While it would be neat and tidy to just blame Wallice for every HIV-infection(Doll was pretty sure she got it overseas when performing with a guy she later learned was HIV+) in porn, there isn't going to be anyway the evidence will ever prove that.

distorting the facts. While it would be great to bring Wallice to "justice" if he was knowingly(and probably was, let's face it) performing while HIV+ with fake tests, it doesn't really address the central issue which is "what happens if some other dude does the same as Wallice?" (perform while knowing they are HIV+) Unless this expands to drum the slime out of the porn biz who knew he was using fake/no tests(if anyone did) and performing , it's not really going to accomplish much. What I get from all of this is that some people in porn are already over "condom scenes" and would like a reason to join the majority in releasing condom-less porn."

FSC Insurance coordinator Greg Zeboray: "Nobody but Marc knows whether or not he knew [he was HIV positive and kept working anyway]. I believe in my heart that Marc did not know."

Chloe met with the flu-ridden Russ Hampshire Friday afternoon. She directs for VCA Xplicit and they went over contracts for several more videos.
